Turkey’s Council of State Ignores ECHR Verdict

Turkey’s Council of State confirmed a lower court ruling on the rejection of repartition demand in the case of Abdullah Yaşa - a 13 year old victim of police canisters during a demonstration in Diyarbakır in 2006. The council ignored an ECHR verdict on the same case. 

Repartition demanded rejected

On 28 March 2006, a funeral has been held to bid farewell to 14 HPG members who were killed after armed clashes with Turkish Army in Şenyayla countryside in the eastern province of Muş. Police intervened the farewell ceremony, leaving 10 demonstrators (including children) killed and scores injured. 

Abdullah Yaşa (13) has been injured due to a police canister hitting his head. The Yaşa family applied to Diyarbakır 2nd Administrative Court for the compensation of damages - a demand that has been rejected, saying that “the injuries have been inflicted following illegal demonstrations”. 

After the local court ruling, the family took the case to Turkey’s Council of State. The panel of council’s 10th Penal Chamber unanimously confirmed  the local ruling and rejected the repartition demand. 

ECHR found Turkey guilty 

Concerning the case, Human Rights Association (IHD) Diyarbakır Branch applied to the European Court of Human Rights. The court found Turkey guilty, ordering the Turkish state to pay for damages. It also ruled that Turkey violated European Convention of Human Rights with its usage of pepper gas in public interventions. (ST/HK)
