Constitutional Court Cancels Omnibus Bills Articles

Turkey’s Constitutional Court cancelled 5 articles of an omnibus bill (Law No 6111) regarding the Telecommunication Authorities (TIB), privatizations and disciplinary grounds for state workers. 

Submitted by Republican People’s Party (CHP) members, an objection requested the cancellation of the aforementioned omnibus bill which passed from the parliament on September 9 after an average of 12 hour load for 9 days. The omnibus bill included 148 articles. 

According to the Constitutional Court ruling, TIB will not be able to shut down websites within 4 hours upon a complaint.

Ratified by President Recep Tayyip Erdoğan, the aforementioned article was imposed to TIB in cases where “national security”, “protection of public order”, “prevention of crimes” and “situation when delay poses a complication” were at stake. 

4 other articles cancelled

The remaining article that were cancelled by the Constitutional Court included the following matters: 

* TIB will not be able to store traffic data

* Privatizations after 5 years can be a subject to cancellation 

* Dismissed state workers will be able to return to their post without the 2-year limit. 

* State worker supervisors refusing to return workers to post can be subject to investigations. (HK/BM)
